Gîte Rental – Gîte La Marnière
Purpose
These Terms and Conditions of Sale (TCS) govern the reservation and rental of the gîte “La Marnière,” located at 16 Le Bois Joubert 37150 Luzillé, by any individual or legal entity through the website https://gitelamarniere.fr. The rental is offered as a seasonal holiday rental for exclusive short-term residential use.
Capacity
The gîte can accommodate up to 12 guests. Any reservation exceeding this number without the prior agreement of the owner may be refused.
Reservation and Payment
The reservation becomes effective after:
- Acceptance of these TCS
- Receipt of a deposit equal to 30% of the total rental amount
- Written confirmation from the owner (by email or letter)
Le solde du séjour est à régler au plus tard 45 jours avant l’arrivée.
Pour toute réservation effectuée à moins de 30 jours de l’arrivée, le règlement intégral est exigé à la réservation.
Payment Methods
Payments may be made by bank transfer, cheque, cash, or through a secure online payment platform.
Security Deposit
Un chèque de caution de 700 € (non encaissé) est demandé à l’arrivée. Si aucun dommage n’est constaté après l’état des lieux de départ, la caution est restituée au locataire, sous huit jours après le départ. Dans le cas contraire, elle est restituée 2 mois au maximum après la date de départ, déduction faite :
- any damage found in the property or its equipment,
- missing items,
- or additional cleaning charges due to excessive dirtiness requiring more than the usual end-of-stay cleaning.
The amount is determined by mutual agreement between owner and tenant. In case of disagreement, a quote will be provided by a professional or authorized body, requested by the tenant before departure or, failing that, by the owner during the final inspection. This deposit shall in no case be considered as a payment toward the rent.
Cette caution ne pourra en aucun cas être considérée comme participation au paiement du loyer.
Cancellation
By the tenant:
- Plus de 30 jours avant l’arrivée : remboursement de l’acompte, moins 30 € de frais de dossier
- De 30 au jour de l’arrivée : aucun remboursement
No refunds will be issued in case of no-show or early departure.
In the event of a shortened stay, the full amount remains due.
We strongly recommend subscribing to travel cancellation insurance.
By the owner:
In case of force majeure or unavailability of the property, the stay will be fully refunded. No additional compensation may be claimed by the tenant.
Arrival and Departure Times
- Arrival: from 5:00 p.m.
- Departure: before 10:00 a.m.
Adjustments may be considered depending on availability.
Pets
Pets are not allowed unless prior written agreement has been given.
Utilities
Water and electricity are included in the rental price, within reasonable usage limits.
House Rules
The tenant agrees to respect the premises and not to cause any nuisance (noise, damage, misconduct).Smoking is not permitted inside the gîte.
An information booklet is provided, containing instructions for waste sorting, water and energy saving, and safety rules.
Insurance
Le locataire est responsable des dommages qu’il peut occasionner aux biens loués, mobiliers ou immobiliers. Pour couvrir ce risque, il est tenu d’assurer le local qui lui est loué. Il doit donc vérifier si son contrat d’habitation principale prévoit l’extension « villégiature » ou « location de vacances ». Sinon, il doit intervenir auprès de son assureur pour demander l’extension de la garantie ou bien souscrire un contrat particulier, au titre de la clause « villégiature ».
Liability
The owner cannot be held liable for theft, loss, or damage suffered by the tenants during their stay.

Disputes
In the event of a dispute, an amicable resolution will be sought. If no agreement is reached, only the courts with jurisdiction over the location of the property will be competent.
