Gîte Rental – Gîte La Marnière

Purpose

These Terms and Conditions of Sale (TCS) govern the reservation and rental of the gîte “La Marnière,” located at 16 Le Bois Joubert 37150 Luzillé, by any individual or legal entity through the website https://gitelamarniere.fr. The rental is offered as a seasonal holiday rental for exclusive short-term residential use.

Capacity

The gîte can accommodate up to 12 guests. Any reservation exceeding this number without the prior agreement of the owner may be refused.

Reservation and Payment

The reservation becomes effective after:

• Acceptance of these TCS
• The tourist tax, collected on behalf of the local authority, is calculated based on the applicable rate per night and per adult, and is added to the cost of the stay.
• Receipt of a deposit equal to 30% of the total rental amount
• Written confirmation from the owner (by email or letter)

The balance of the stay must be paid no later than 45 days before arrival.
For any reservation made less than 45 days prior to arrival, full payment is required at the time of booking.

Payment Methods

Payments may be made by bank transfer, cheque, cash, or through a secure online payment platform.

Security Deposit

A security deposit of €700 (uncashed cheque) is required upon arrival. If no damage is found after the departure inspection, the deposit will be returned to the tenant within eight days of departure. Otherwise, it will be returned no later than two months after the departure date, minus deductions for:

• any damage found in the property or its equipment,
• missing items,
• or additional cleaning charges due to excessive dirtiness requiring more than the usual end-of-stay cleaning.

The amount is determined by mutual agreement between owner and tenant. In case of disagreement, a quote will be provided by a professional or authorized body, requested by the tenant before departure or, failing that, by the owner during the final inspection. This deposit shall in no case be considered as a payment toward the rent.

This security deposit may under no circumstances be considered a contribution towards the payment of rent.

Cancellation

By the tenant:

• More than 45 days before arrival: refund of the deposit
• From 45 days prior to the day of arrival: no refund.

No refunds will be issued in case of no-show or early departure.

In the event of a shortened stay, the full amount remains due.

We strongly recommend subscribing to travel cancellation insurance.

By the owner:

In case of force majeure or unavailability of the property, the stay will be fully refunded. No additional compensation may be claimed by the tenant.

Arrival and Departure Times

• Arrival: from 5:00 p.m.
• Departure: before 10:00 a.m.

Adjustments may be considered depending on availability.

Pets

Pets are not allowed unless prior written agreement has been given.

Utilities

Water and electricity are included in the rental price, within reasonable usage limits.

House Rules

The tenant agrees to respect the premises and not to cause any nuisance (noise, damage, misconduct).Smoking is not permitted inside the gîte.

An information booklet is provided, containing instructions for waste sorting, water and energy saving, and safety rules.

Insurance

The tenant is liable for any damage caused to the rented property, whether to the premises themselves or to the furnishings. To cover this risk, the tenant is required to insure the rented property. They must therefore verify whether their primary home insurance policy includes a "holiday rental" or "vacation rental" extension. If not, they must contact their insurer to request an extension of coverage or take out a separate policy under the "holiday rental" clause.

Liability

The owner cannot be held liable for theft, loss, or damage suffered by the tenants during their stay.

Personal data collected is used solely to manage bookings and will never be shared with third parties without consent. See our privacy policy.

Disputes

In the event of a dispute, an amicable resolution will be sought. If no agreement is reached, only the courts with jurisdiction over the location of the property will be competent.
